Terms and Conditions


Introduction
Couriernow® (Couriernow Pty Ltd ACN 136 809 473, hereinafter “Couriernow” or the “Company”) of 94 Meeks Road Marrickville NSW 2024 Australia is a service offering immediate comparison and booking of third party courier shipping and freight services hereby referred to as the Carrier(s).

You are agreeing on your own behalf and on behalf of all other interested parties in the consignment (you and all such parties hereinafter referred to as “you” or "Customer"). By using the Couriernow website and/or services, you acknowledge that you have read, understand and agree to be bound by these Terms and Conditions. Your statutory rights and entitlements will remain unaffected. These Terms and Conditions shall apply until alteration or amendment by Couriernow and supersede any previous agreements. The Company may discontinue or alter the terms of these Terms and Conditions or their availability at any time without notice. You agree to be bound by such changes by using the Couriernow website or services after changes are made to these Terms and Conditions. The Customer further agrees to the Carrier’s Terms and Conditions as supplied and managed by the Carrier. The Carrier’s Terms and Conditions will, in all instances and when not in conflict with the Company's Terms and Conditions, take precedence in all proceedings.


General
Couriernow provides links to websites maintained by third parties, for convenience and information only. Couriernow does not control other websites’ content, and accessing websites is entirely at visitors’ own risk. Providing links to third party websites does not mean the Company endorses, authorises or sponsors such websites nor that Couriernow is affiliated with any third parties. Couriernow may refuse or cancel a login and password that impersonates another person, is protected by proprietary law, and is vulgar or otherwise offensive. Carriers can only collect from and deliver to a full street address. No collections from or deliveries to PO Boxes will be made. If a collection is booked and rejected by a carrier using a PO Box, Couriernow may charge a handling fee. If a consignment is collected and returned for this reason, the Company reserves the right to not pay a refund.

If Recipient refuses delivery or cannot be identified or located, or the consignment has been deemed unacceptable or undervalued for customs purposes, the Carrier shall use reasonable efforts to return the consignment to you at your cost.

The Carrier has the right to open and inspect a consignment without prior notice to the Customer or the Company. Unless otherwise agreed and in order to comply with local and international regulations, all consignments shall be left open for inspection by the Carrier on collection. Photographic identification of the sender shall be required for the collection.

The Couriernow system arranges collections booked by the Customer. If a collection fails you must contact the Company so an alternative collection can be organised as soon as possible.

The Customer is solely responsible for maintaining confidentiality of their login and password. You are solely responsible for all information provided including but not limited to labels correctly completed, attached to and displayed on consignment items. Couriernow does not provide any Customer data and information to third parties, unless legally required to do so.

The Customer agrees to notify the Company immediately when changing contact details i.e. address or email so the Company can contact you as required. If you fail to notify us promptly of a change, any notice we send to your old address or email shall be deemed sufficient notice.

These Terms and Conditions constitute binding and enforceable obligations of Customer. The Company may terminate or restrict access to services if, in its opinion, the Customer’s use of services may be unlawful, infringe on a person's rights, and/or violate the terms of this Agreement.

Unacceptable Consignments
Couriernow does not accept goods which
a) Are classified as “Dangerous Goods”. Failure to declare Dangerous Goods could lead to action by relevant government authorities with the possibility of fines and/or jail terms.

Dangerous Goods means any goods of a dangerous or hazardous nature whether you were aware of the dangerous or hazardous nature of the goods or not, and includes, without limitation, goods forbidden, limited or restricted from time to time by:

  1. the Australian Dangerous Goods Code;
  2. the Australian Dangerous Goods Code;
  3. the International Air Transport Association ("IATA");
  4. the International Civil Aviation Organisation; or,
  5. any applicable law, regulation, guideline or requirement of a regulatory body or government department of a country from which, through which or into which the Goods are carried.s

b) The Carrier decides it cannot transport safely and / or legally. Such items include and are not limited to firearms and ammunition, illegal drugs/ narcotics.

Unacceptable Consignments could be subject to non-collection, delay or return. If an unacceptable consignment is collected and then later returned, full carriage may be charged and additional charges may be charged.

The Customer shall be liable for any damage caused in transit to other property resulting from sending an Unacceptable Consignment.

Any item shipped using Dangerous Goods, Hazardous or Unacceptable Consignment packaging and /or labels will be classed and treated as such.


Rates & Payment
Rates and services information displayed by Couriernow is provided by the Carriers and subject to change without notice. Rates quoted are based on the Carrier’s service in addition to the consignment dimensions and weight supplied by the Customer. Rates applying to forward bookings completed will be honoured.

Rates are based on the greater of actual or dimensional weight. If actual consignment weight is greater than that booked or additional services are required to perform the pickup, transportation and delivery functions, additional charges and transit delays may apply. Couriernow will charge additional payments to the Customer’s credit card within 14 working days of the shipment taking place. In the event of refunds Couriernow will credit the Customer’s credit card within 10 working days.

Neither Couriernow nor the Carriers are liable for any customs charges.

Unless specified otherwise in writing by Couriernow, all fees and charges are non-refundable. The currency applying to all rates and charges referred to on this web is the Australian Dollar AUD$.

Rates are based on the greater of actual or dimensional weight. If actual consignment weight is greater than that booked or additional services are required to perform the pickup, transportation and delivery functions, additional charges and transit delays may apply. Couriernow will charge additional payments to the Customer’s credit card within 14 working days of the shipment taking place. In the event of refunds Couriernow will credit the Customer’s credit card within 10 working days.

Some remote areas are subject to a remote area surcharge. This will be calculated in the Company’s quoting system.

Unless otherwise specified, consignments booked through Couriernow are not insured. Rates do not include insurance. Should the Customer want insurance, please contact your Couriernow account manager.

Warranties and Liability
The Customer shall indemnify and hold the Company and the Carrier harmless for any loss or damage arising out of the Customer’s failure to comply with any applicable laws or regulations and for the Customer’s breach of the following warranties and representations:

  1. All information provided by the Customer is complete and accurate;
  2. he consignment was prepared in secure premises by the Customer, by reliable staff employed by you;
  3. You protected the consignment against unauthorised interference during preparation, storage and transportation to the Carrier;
  4. The consignment is properly marked and addressed and packed to ensure safe transportation with ordinary care in handling;
  5. All applicable laws ordinances and regulations have been complied with; and
  6. You have signed all relevant documentation.
